Ferno Rescue Academy Website Terms and Conditions of Use

These Terms & Conditions (“Terms”) govern your access to and use of Ferno Rescue Academy (“the Platform”), provided by Ferno Group, Inc., 70 Weil Way, Wilmington, Ohio 45177, USA (“Ferno”, “we”, “us”, “our”).

By creating an account, accessing the Platform, or using any content on the Platform, you agree to these Terms.

1. Purpose of the Platform

Ferno Rescue Academy provides basic-level educational content, including videos, informational modules, demonstrations, and general guidance relating to Ferno products (“Content”).

competency assessment
a substitute for professional instruction
manufacturer-approved qualification
evidence of readiness or authorisation to perform rescue activities

Users must obtain all appropriate formal, practical, and accredited training as may be required by their organisation, jurisdiction, or regulatory authority.

2. Mandatory User Responsibilities

By using the Platform, you acknowledge and agree that:

You are responsible for:

understanding the limitations of the equipment
following all safety protocols
obtaining adequate supervised practice
complying with employer, national, and local regulations
ensuring you are competent to use equipment in real environments

2.2. The Platform does not certify or qualify you to use any equipment

Completion of modules or viewing of content does not indicate skill, competence, or authority to perform rescue activities.

2.3. You should consult the official user manual for every Ferno product before use

The official product instructions take precedence over all Platform content.

3. Eligibility

You must be at least 18 or have legal capacity to enter agreements. The Platform is not intended for children under 13.

4. Account Registration and Security

You must provide accurate information and maintain the confidentiality of your login credentials.
You are responsible for all actions under your account.

5. Acceptable Use

You agree not to:

copy or redistribute Platform content
interfere with Platform security
upload harmful or malicious files

We may suspend accounts that violate these Terms.

6. Leaderboards and Usernames

Leaderboards may display user engagement with educational content.

Only your chosen username will be shown publicly.
You may request removal or update at any time.

7. Intellectual Property

All Content and materials on the Platform are owned by Ferno Group, Inc. or licensed third parties.

You receive a limited licence to access and view Content solely for personal or organisational educational use.

You may not copy, modify, distribute, or use Content for commercial or competitive purposes.

8. Licence to Use the Platform

It does not transfer ownership of any Content.

9. Platform Availability

10. Educational Content Disclaimer

By using the Platform, you acknowledge that:

It is not formal training, is not a substitute for hands-on or accredited instruction, and does not constitute qualification or certification for you to operate any rescue or medical equipment.

You must consult a qualified rescue professional or instructor in your own region for proper training, competency assessment, and safe operational instruction.

You must always read, understand, and follow the official user manual for every Ferno product before use.

You are solely responsible for using equipment safely and correctly, in compliance with all manufacturer instructions, employer protocols, and applicable laws and regulations.

Ferno does not guarantee that completing or viewing any content establishes skill, competence, or readiness for real-world application.

11. Disclaimer of Warranties

The Platform and all Content are provided “as is” and “as available”, without warranties of any kind.

We do not warrant:

accuracy or completeness of educational content
suitability for real-world rescue scenarios
uninterrupted access to the Platform

12. Limitation of Liability

To the fullest extent permitted by law, Ferno is not liable for:

injury, damage, or loss resulting from reliance on educational content
improper use of products
missed regulatory or training requirements
indirect or consequential damages

13. Indemnification

You agree to indemnify Ferno against claims arising from misuse of equipment, reliance on educational content, or violation of these Terms.

14. Termination

We may suspend or terminate accounts as needed.
Upon termination, your access privileges are revoked.
